GENERAL TERMS AND CONDITIONS<\/strong><\/span><\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li><span style=\"color: #000000;\"><strong>Breeding Season:<\/strong> The breeding season begins on <strong>February 15<\/strong> and ends on <strong>September 1<\/strong> of each year, unless otherwise agreed between the breeder and the stallion owner.<\/span><\/li>\n<li><span style=\"color: #000000;\"><strong>Acknowledgment of Terms:<\/strong> By ordering semen, you acknowledge the breeding regulations, payment terms, and the insemination contract.<\/span><\/li>\n<li><span style=\"color: #000000;\"><strong>Proof of Parentage:<\/strong> Proof of parentage and\/or the breeding certificate must be submitted before the first covering.<\/span><\/li>\n<li><span style=\"color: #000000;\"><strong>Viewing Stallions:<\/strong> A visit to the station stallions is possible by prior telephone appointment.<\/span><\/li>\n<li><span style=\"color: #000000;\"><strong>Prices:<\/strong> All stated breeding fees, shipping costs, and prices are net prices plus the applicable statutory VAT.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><span style=\"color: #000000;\"><strong>2. STABLE STAYS<\/strong><\/span><\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul style=\"list-style-type: circle;\">\n<li><span style=\"color: #000000;\"><strong>Box Prices:<\/strong> Boxes with regular turnout in paddocks are available:<\/span>\n<ul style=\"list-style-type: circle;\">\n<li><span style=\"color: #000000;\">Mare without foal: <strong>\u20ac30\/day<\/strong><\/span><\/li>\n<li><span style=\"color: #000000;\">Mare with foal: <strong>\u20ac35\/day<\/strong><\/span><\/li>\n<\/ul>\n<\/li>\n<li><span style=\"color: #000000;\"><strong>Discount for Guest Mares:<\/strong> Mares that are bred with a station-owned stallion receive a <strong>10%<\/strong> discount for their stay.<br \/>\n<\/span><\/li>\n<li><span style=\"color: #000000;\"><strong>Processing Fee:<\/strong> For external stallions, <strong>\u20ac150<\/strong> per cycle.<\/span><\/li>\n<li><span style=\"color: #000000;\"><strong>Swab Test:<\/strong> A swab test before insemination is required.<\/span><\/li>\n<li><span style=\"color: #000000;\"><strong>Veterinary Costs:<\/strong> Will be billed separately.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><span style=\"color: #000000;\"><strong>3. A change of mare must be requested.<\/span><\/p>\n<p>&nbsp;<\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li><span style=\"color: #000000;\"><strong>Fresh Semen Portions:<\/strong> Up to <strong>three<\/strong> portions of fresh semen will be sent per cycle (maximum of <strong>three<\/strong> cycles). An exception is made for the stallion Vingino, for which a maximum of <strong>two<\/strong> portions per cycle applies.<\/span><\/li>\n<li><span style=\"color: #000000;\"><strong>Logistics Company:<\/strong> Shipping is carried out by an external company. Hengststation Bachl assumes no liability for timely and undamaged delivery.<\/span><\/li>\n<li><span style=\"color: #000000;\"><strong>Shipping Costs:<\/strong> The costs for semen shipping are borne by the breeder and must be inquired separately from the stallion owner.<\/span><\/li>\n<li><span style=\"color: #000000;\"><strong>Health Papers:<\/strong> The health papers required by EU animal breeding law (Traces) for shipping semen abroad are also at the breeder&#8217;s expense and will be charged at <strong>\u20ac60<\/strong>.\u00a0\u00a0\u00a0 <strong>Important:<\/strong> We require the registered address and number of your veterinary office in the Traces system. This address must be registered and activated in the &#8220;Traces&#8221; system before shipping can occur. Without this information, no shipping can take place.<\/span><\/li>\n<li><span style=\"color: #000000;\"><strong>Stallion Availability:<\/strong> If a stallion is not available during the breeding season for special reasons (e.g., tournament participation, illness), TG semen may be used or a stallion change offered.<\/span><\/li>\n<li><span style=\"color: #000000;\"><strong>Semen Use Confirmation:<\/strong> For each semen shipment, the semen use confirmation must be filled out and returned immediately (also possible via fax or email). The mare owner commits to returning all semen use confirmations by <strong>September 15<\/strong> <strong>at the latest<\/strong>.<\/span><\/li>\n<li><span style=\"color: #000000;\"><strong>Insemination Certificate:<\/strong> For insemination agents or self-inseminators, a copy of the insemination certificate is required before the first insemination.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><span style=\"color: #000000;\"><strong>4. BREEDING FEES AND OTHER TERMS<\/strong><\/span><\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li><span style=\"color: #000000;\"><strong>Payment Terms:<\/strong> The first installment of the breeding fee is due in advance with the initial order.<\/span><\/li>\n<li><span style=\"color: #000000;\"><strong>Shipping Abroad:<\/strong> International shipments are only made against prepayment of the first installment of the breeding fee, shipping costs, and any required official veterinary certificate (Traces). Please register your address in the European Traces database. Your address must be valid, otherwise we cannot send you seeds.<\/span><\/li>\n<li><span style=\"color: #000000;\"><strong>Invoicing:<\/strong> Invoices are to be paid within 10 days from the invoice date. This does not apply to the first installment of the breeding fee that must be paid in advance. If payment deadlines are exceeded, the invoice amount will increase by an administrative fee as well as any collection costs incurred, both judicial and extrajudicial. Only one discount or voucher can be redeemed per breeding fee\/invoice.<\/span><\/li>\n<li><span style=\"color: #000000;\"><strong>Pregnancy Acceptance:<\/strong> If we do not receive feedback on pregnancy within eight weeks after shipment, pregnancy will automatically be assumed and the second installment \/ the pregnancy rate will be invoiced.<\/span><\/li>\n<li><span style=\"color: #000000;\"><strong>Due <\/strong><strong>Dates for Installments:<\/strong> On <strong>September 15<\/strong>, all outstanding pregnancy installments will automatically become due and invoiced.<\/span><\/li>\n<li><span style=\"color: #000000;\"><strong>Proof of Non-Pregnancy:<\/strong> To recognize non-pregnancy, a veterinarian-confirmed proof must be submitted by <strong>September 30<\/strong> of the breeding year.<\/span><\/li>\n<li><span style=\"color: #000000;\"><strong>Breeding Certificate:<\/strong> The issuance of the breeding certificate and its transfer to the respective breeding association occurs only after all breeding fee invoices have been settled and all other incurred costs have been balanced.<\/span><\/li>\n<li><span style=\"color: #000000;\"><strong>Contractual Penalty for Unauthorized Use:<\/strong> Only one foal may be conceived per breeding fee. In case of unauthorized use of semen (e.g., insemination of unregistered mares or failure to report a successful embryo transfer), an additional contractual penalty of <strong>\u20ac2500<\/strong> will be imposed along with any outstanding amounts.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><span style=\"color: #000000;\"><strong>5. SPECIAL CONDITIONS<\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>Important:<\/strong> For mares that have successfully produced offspring measuring <strong>1.30 m or higher<\/strong> or whose offspring measure <strong>1.30 m or higher<\/strong> successfully, we grant a discount of <strong>10%<\/strong> on each installment. Please note this in writing with your order.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"color: #000000;\"><strong>6. FROZEN SEMEN (TG SEMEN)<\/strong><\/span><\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li><span style=\"color: #000000;\"><strong>Ownership and Use:<\/strong> The TG semen remains property of Hengststation Bachl. In case of non-use, the semen must be returned to us. Transfer to third parties or use on non-designated mares is not permitted.<\/span><\/li>\n<li><span style=\"color: #000000;\"><strong>Return of Straws:<\/strong> The mare owner commits to returning all unused straws from frozen semen within <strong>14 days<\/strong> after knowledge of successful insemination to Hengststation Bachl. Shipping costs are borne by the mare owner.<\/span><\/li>\n<li><span style=\"color: #000000;\"><strong>Usage Confirmations:<\/strong> The accompanying usage confirmations must be filled out and signed by a veterinarian or insemination technician and returned to us immediately after insemination along with empty straws.<\/span><\/li>\n<li><span style=\"color: #000000;\"><strong>Shipping Costs:<\/strong> For shipping frozen semen in a container from Hengststation Bachl, we charge a rental fee as well as a nitrogen fee.<\/span><\/li>\n<li><span style=\"color: #000000;\"><strong>Return of Shipping Containers:<\/strong> Shipping containers and frozen containers must be returned insured and sufficiently stamped within <strong>three days<\/strong>. In case of late return of frozen containers, we reserve the right to organize return transport after <strong>four days<\/strong> at the expense of the mare owner. The customer is liable for undamaged return shipping of containers.<\/span><\/li>\n<li><strong>Portion Sale:<\/strong> For purchasing frozen semen, please contact our office.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><span style=\"color: #000000;\"><strong>7. EMBRYO TRANSFER, ICSI AND OTHER ADVANCED REPRODUCTIVE TECHNIQUES<\/strong><\/span><\/p>\n<ul style=\"list-style-type: circle;\">\n<li><span style=\"color: #000000;\"><strong>Notification Obligation:<\/strong> A embryo transfer or ICSI must be communicated to us in advance and is only permitted after prior consultation with our office and a written agreement. Embryos obtained from fresh or frozen semen must be paid for in the year the semen is provided.<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><span style=\"color: #000000;\"><strong>8. LIVE FOAL GUARANTEE<\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\">This measure serves to support breeders.<\/span><\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li><span style=\"color: #000000;\"><strong>Payment Terms:<\/strong> The first installment is payable in advance.
